            <title>Big Issues That Got Short Shrift</title>
            <description><![CDATA[<p>The media consensus about the recently completed hearings on Judge <strong>Sonia Sotomayor</strong>'s nomination seems to be that it was a waste of everybody's time, with Republican senators asking "gotcha" questions and the nominee sticking to cautious bromides of the I-just-apply-the-law variety.</p>

<p>"While her confirmation hearings drew plenty of coverage last week," wrote <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/07/20/AR2009072000735.html"><strong>Howard Kurtz</strong></a> in the <em>Washington Post</em>, "the level of media excitement hardly matched that surrounding <strong>Mark Sanford</strong>'s Argentine affair, <strong>Sarah Palin</strong>'s Alaskan exit or <strong>Michael Jackson</strong>'s untimely departure."</p>

<p>True enough. But it's also true that most of the media missed a major opportunity to use the hearings as a peg for background pieces and news analyses explaining to readers and listeners some of the big issues on which so little light was shed by the senators and the nominee.</p>

<p>The media know how to do that sort of thing in other contexts. Consider the way in which the <em>New York Times</em> and others have used the 40th anniversary of the first moon landing for fascinating explorations of the past, present and future of space travel, including everything from the lunar lander's technology to the astronauts' subsequent lives.</p>

<p>But how much insight did the media offer on the complex but important issues that came up during the Sotomayor hearing? Issues such as these:</p>]]></description>

					<![CDATA[<p>The hearings were really completely unnecessary, because you only have to look at what Obama said that he wanted in a judge to know who she is.<br />

When it comes to the selection of Supreme Court nominees Obama disagreed with fellow Democrats over the selection of Justices Roberts and Alito and voted against their confirmation in spite of their excellent legal credentials. He would apparently use an entirely different yardstick to the tried and tested one and stated,</p>
<p>&ldquo;We need somebody who&rsquo;s got the heart, the empathy, to recognize what it&rsquo;s like to be a young teenage mom. The empathy to understand what it&rsquo;s like to be poor, or African-American, or gay, or disabled, or old. And that&rsquo;s the criteria by which I&rsquo;m going to be selecting my judges&rdquo;.</p>

					<![CDATA[<p>The one obvious thing from the hearings is that none of the Judiciary Committee members&nbsp;are&nbsp;or were,&nbsp;real trial attorneys, except for perhaps John Kyl. Judge Sotomayor, and all judicial nominees should be questioned much as in a deposition. No time should be wasted with laudatory comments, or silly observations. The nominees should be restricted to &quot;yes&quot; and &quot;no&quot; answers, and no quarter should be given for deception, or evasion (I can't answer that, because I may have to rule on it later). Yes, we want to know how you would rule on it, based on what you know today. And please, no more family members in the audience after the first 15 minutes.</p>...]]>
